The EB-1 visa is the highest-priority employment-based green card category, available to aliens of extraordinary ability (EB-1A), outstanding professors and researchers (EB-1B), and multinational managers and executives (EB-1C). EB-1 applicants generally do not require PERM labor certification, making it faster than most employment-based green card categories.
EB-1A (Extraordinary Ability) requires demonstrating sustained national or international acclaim in sciences, arts, education, business, or athletics through evidence such as major awards, high salary relative to peers, critical roles in distinguished organizations, published work, or judging others in the field. No employer sponsor is required — EB-1A can be self-petitioned. EB-1B (Outstanding Researchers/Professors) requires international recognition in a specific academic field and a permanent job offer from a university or qualifying research institution. EB-1C (Multinational Managers/Executives) requires having worked for a related overseas entity for at least one year in the past three years and being transferred to a US affiliate. EB-1 has current priority dates for most countries, avoids the lengthy PERM labor certification process, and is often the fastest path to permanent residence for qualifying individuals.
EB-1 qualification requires carefully documenting a pattern of achievement that meets USCIS's evidentiary standards — standards interpreted strictly. Many qualified individuals are unaware they might qualify for EB-1A in particular.
